Forfeiture and calibration of cameras

For fines for breaches of speed limits foreseen by art. 142 CDS relation to automatic control equipment (known as speed cameras) there is no legislation which imposes the revocation of approvals granted, it follows that, in the lawsuit it filed against the fine, there is no further burden of proof borne by the Administration on the continuing functionality of those devices. As for the calibration was also clarified that the electronic equipment used regularly certified to detect violations of speed limits established (so-called camera), as required by art. 142 Security Council, should not be subjected to controls under the law establishing the national system calibration (Cass. civ. Sec. II Sent., 08.02.2010, No. 18007).
