Payment of the fine to a lesser extent, that the amount indicated in the same fine and equal to the minimum of the penalty imposed by law "necessarily implies the acceptance of penalty" and, therefore, the recognition on the part of the infringer's own responsibility and, consequently, a waiver to use the Justice of the Peace (Cass. civ. Sec. II Sent., 08.06.2010, No. 18457).
